Accommodation Terms and Conditions
Article 1 (Scope of Application)
These Accommodation Terms and Conditions (hereinafter referred to as the “Terms”) set forth the rights and obligations between HASHIBA (hereinafter referred to as the “Auberge”) and guests entering into accommodation contracts and related agreements.
Any matters not stipulated in these Terms shall be governed by applicable laws and generally established customs.
In cases where the Auberge agrees to special provisions that do not conflict with laws or customs, such special provisions shall prevail over these Terms.
Article 2 (Application for Accommodation Contract)
Guests applying for accommodation or making reservations shall provide the following information to the Auberge:
(1) Name and contact information of the guest
(2) Dates of stay
(3) Selected accommodation plan
(4) Any other information deemed necessary by the Auberge
If a guest requests an extension of their stay beyond the originally reserved dates during their stay, such request shall be treated as a new application for accommodation at the time the request is made.
The accommodation plan selected at the time of reservation shall apply only to the original booking. Any changes require a new reservation application.
Transfer of contractual status or rights to a third party is prohibited unless explicitly approved by the Auberge.
Article 3 (Formation of Accommodation Contract)
The accommodation contract shall be deemed concluded when the Auberge accepts the reservation request. However, certain accommodation plans may require confirmation of advance payment for the contract to become effective.
Article 4 (Refusal of Accommodation Contract)
The Auberge may refuse accommodation contracts in the following cases:
(1) Applications not in accordance with these Terms
(2) No vacancy available
(3) When the guest is deemed affiliated with organized crime or antisocial groups
(4) Risk of violating laws or public order and morals
(5) When the guest is suffering from a specified infectious disease
(6) When excessive demands or burdens are imposed upon the
Auberge
(7) Natural disasters, equipment failures, or other unavoidable circumstances
Article 5 (Guest’s Right to Cancel Contract)
Guests may cancel the accommodation contract subject to the cancellation policy and applicable cancellation charges.
If a guest fails to arrive by 6:00 PM without prior notice, the reservation may be deemed canceled by the guest. In such cases, cancellation charges will apply according to the cancellation policy.
Dinner service begins simultaneously for all guests. If arrival is delayed, certain dishes may no longer be served. In cases of significant delay where the Auberge determines service cannot reasonably be provided, the guest shall be deemed to have forfeited the right to receive dinner service, and 100% of the accommodation fee will be charged.
Article 6 (Auberge’s Right to Cancel Contract)
The Auberge may cancel the accommodation contract if the guest engages in conduct contrary to laws, public order, or these Terms.
In such cases, charges for unprovided services will generally not be collected. However, costs already incurred due to reasons attributable to the guest, including ingredient procurement and preparation costs, may still be charged.
Article 7 (Guest Registration)
Guests shall register the following information upon check-in:
Name, address, occupation, and for foreign nationals, nationality and passport number.
Article 8 (Guest Room Usage Hours)
Guest rooms may be used from check-in until check-out according to each accommodation plan.
Article 9 (Compliance with House Rules)
Guests shall comply with the house rules established by the Auberge while on the premises.
Article 10 (Payment of Charges)
Accommodation charges shall be paid at check-out or upon billing.
Charges will apply even if the guest chooses not to stay after the room has been made available.
Article 11 (Storage of Baggage and Personal Belongings)
If baggage or personal belongings are left behind after check-out without the Auberge’s consent, the Auberge shall store them for a certain period in accordance with separately established house rules, after which ownership may be deemed abandoned and items may be disposed of or delivered to the police.
Food items, magazines, and other objects deemed disposable may be discarded on the day of check-out pursuant to the house rules.
Article 12 (Handling of Valuables)
Please notify the Auberge in advance if bringing large amounts of cash or valuables.
Safety deposit boxes are available in guest rooms. Guests are requested to use them for valuables.
The Auberge does not generally accept valuables for safekeeping at the front desk.
Except in cases of intentional misconduct or gross negligence by the Auberge, liability shall not exceed JPY 100,000.
Article 13 (Guest Liability)
Guests shall compensate the Auberge for damages caused intentionally or through negligence.
Article 14 (Entry into Guest Rooms)
The Auberge may enter guest rooms without prior permission when necessary for cleaning, safety confirmation, legal compliance, bath temperature management, room service, or other operational purposes.
Reasonable consideration shall be given to guest privacy at all times.
Article 15 (Parking Liability)
Parking facilities are provided solely as a convenience. The Auberge assumes no responsibility for accidents, theft, or valuables left inside vehicles.
Article 16 (Severability)
If any provision of these Terms is found invalid, the remaining provisions shall remain in full force and effect.
Article 17 (Governing Law and Jurisdiction)
These Terms shall be governed by the laws of Japan.
Any disputes arising in relation to these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court.
Article 18 (Amendments to the Terms)
These Terms may be amended in accordance with applicable laws and regulations.
Any amendments shall be published on the Auberge website.
